General Conditions of Sale

Any order received implies full acceptance of these general conditions of sale valid for orders placed on our e-commerce site. No special condition may, except with the formal and written acceptance of actif-shop.eu (SARL ACTION INDUSTRIE FRANCE), prevail over the general conditions of sale.

1. Acceptance of the order:

The final validation of the order is subject to the approval of ACTION INDUSTRIE FRANCE and in particular subject to the acceptance of our credit department. To place your orders, we provide you with several means:

2. Prices and transport:

The sales prices indicated on our site are in euros and excluding taxes. The online ordering software calculates the VAT in force in France. Shipping costs are due by the customer and are automatically calculated by the software according to the chosen delivery method, the products and their weight.

3. Return of goods:

If you wish to return a product that does not suit you, within 14 days of receiving the products, please contact us by email to organize the return.Please note that the shipping costs will not be refunded and that the return costs are your responsibility. The refund will only be made after receipt of the items and verification of their condition. Please note that if the returned products are not in new condition with their original box, ACTION INDUSTRIE FRANCE reserves the right to apply a discount on them.

A return authorization duly approved by us is required. Please contact us to obtain this agreement.
Regarding defective products, they can be returned, within 14 days after receipt of the goods, directly by the end customer to ACTION INDUSTRIE FRANCE subject to acceptance by our services. The goods must be returned in the original packaging and in the condition.

The amount is paid to the buyer within 15 days when the seller has possession of the returned goods.

4. Delivery time:

Delivery times are given as an indication and will be confirmed upon receipt of orders. Consequently, no delay in delivery or partial delivery can justify a cancellation or refusal of delivery by the buyer, nor any claim for damages.

5. Guarantees:

ACTION INDUSTRIE FRANCE guarantees the products available in its catalog in accordance with the guarantees provided by the manufacturers of the goods.

6. Limitation of liability:

Any order received implies full acceptance of these general conditions of sale. A copy of this document will be provided for any written request. Furthermore, the liability of ACTION INDUSTRIE FRANCE is limited to the repair or exchange of products. Under no circumstances will ACTION INDUSTRIE FRANCE be held liable for damages inherent in the use of the products sold. Any claim concerning the quantity of the product, excluding any loss of goods caused during transit thereof, must be sent by registered letter to ACTION INDUSTRIE FRANCE within 5 days of receipt of the goods.

The goods delivered will remain the property of ACTION INDUSTRIE FRANCE until the buyer has fulfilled all of his obligations towards the seller, and in particular until full payment of the price, where applicable increased by interest. Law 80.335 of 12/05/1980

7. Modification of the terms and conditions:

Any condition not in accordance with the general conditions of ACTION INDUSTRIE FRANCE that the buyer has formulated will be rejected unless the buyer has expressly and in writing acknowledged its applicability.

8. Payment methods and security:

You can pay us by credit card on the secure servers of our banks. This implies that no banking information concerning you passes through the ACTION INDUSTRIE FRANCE site. Payment by credit card is perfectly secure. Your order will thus be recorded and validated upon acceptance by the bank.

9. Security:

Your credit card information is encrypted using the SSL protocol and never passes through the network in clear text. Payment is made directly by the bank. 10. Retention of title clause:

The products remain the property of ACTION INDUSTRIE FRANCE until full payment of the products ordered.

11. Default of payment:

ACTION INDUSTRIE FRANCE reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous invoice. Recovery compensation due 40 euros excluding VAT for non-payment on the due date in accordance with the law.

12. Jurisdiction clause:

Any disputes relating to the formation, execution and termination of contractual obligations between the parties that cannot give rise to an amicable settlement will be submitted to the jurisdiction of the Commercial Court of BREST in the district in which the registered office of ACTION INDUSTRIE FRANCE is located, regardless of the conditions of sale and the method of payment accepted, even in the event of a warranty claim or multiple defendants, ACTION INDUSTRIE FRANCE reserving the right to refer the matter to the territorially competent Court in which the buyer's registered office is located. This contract is governed by French law. The application of the Vienna Convention on the International Allocation of Goods is expressly excluded.
